Circumstances of Case:

Police received a call at 5.45am on the 15th November 2015 about a young lady in a state of distress this young lady was identified by police as Miss Betty Primrose. I understand that Miss Primrose believes that she has been a victim of a drug-facilitated sexual assault, which had taken place around 10.30pm on the 14th November 2015. Miss Primrose identified the alleged suspect as Mr Peters of 46 Coach Lane Newcastle. Miss Primrose was conveyed to a sexual assault referral centre and was medically examined by a forensic medical examiner at 7.38 am 15th November 2015. A blood and urine sample along with a sample from a glass tumbler was obtained for toxicological analysis.

Purpose of Examination:

I have been asked to screen the blood, urine and glass tumbler samples for the presence of alcohol and other drugs of abuse.

Points to Prove:

Provide a statement determining whether there is evidence to support that PETERS administered a stupefying substance to PRIMROSE for the intention of sexual assault.

Examination and Results

Alcohol was found in the urine (23 mg/100mL)

Temazepam was found in the urine (0.008 mg/L)

Oxazepam was found in the urine (0.04 mg/L)

No other drugs were found in the urine sample.

Alcohol was found in the blood (13 mg/100mL).

Temazepam was found in the blood (0.056 mg/L)

No other drugs were found in the blood sample.

JA01 labelled ‘Glass tumbler recovered from living room floor, 46 Coach Lane 0932 hrs on 15/11/15'

The glass tumbler was found to contain a dried off white residue. On examination this residue was identified to be temazepam.
