Question: The Sayets agreed to buy property owned by the Cayres. They deposited $10,000 with Beekay Realty. Their contract to buy was subject to their obtaining a mortgage. The Sayets made few attempts to secure a mortgage. They were never turned down but their applications were rejected because the Sayets failed to provide the information requested. The Sayets sued to get their deposit back and to cancel the transaction. Are they entitled to do this? (Beekay Realty Corp. v. Cayre, Florida 256 So 2d 539)
