The letter discussed the debt and advised the attorney that the debt might be nondischargeable, and the company would like to settle the matter if counsel did not believe that there was a defense to the claim. After discovering a letter was sent to a third party instead of her, Villegas sued Weinstein for violation of the Fair Debt Collection Practices Act.
