Samantha and David dated for 3 years. During the relationship, David drank heavily and was characterized by Samantha as "immature." Eventually, Samantha ended it, citing David's inability to provide her with a stable and nurturing relationship. As time went on, Samantha embarked on another relationship with Tim.

Even as the two were apart, David and Samantha maintained telephone contact. During a weekend while Tim was out of town, Samantha telephoned David to see if he would like to accompany her to a town more than an hour and a half away to pick up bicycle parts. David agreed. The two of them drove there in Samantha's car.

Once they arrived in town, David and Samantha purchased bicycle parts, checked into a local hotel, ate dinner at a local restaurant, attended a movie at a local theater, and then returned to the hotel.

Early the next morning, the hotel clerk received a telephone call from a female voice refusing to identify herself. The voice said, "There has been a rape in room 217," and then hung up. The clerk called the police.

When police responded to room 217, they found an empty room with a bed that had been disturbed. They determined that a David Baxter had purchased the room with a Visa credit card. The vehicle associated with the check-in slip was registered to a Samantha Anderson. The police collected the bed sheets and a condom wrapper they found in the trash can.

When police contacted Samantha Anderson, she reported to them that David Baxter had raped her during their stay at the hotel room. Samantha told police that after they had attended the movie, she and David returned to the hotel room where they fell asleep on the bed. Samantha admitted to drinking heavily that evening. She said that when she woke up, David was on top of her having sex with her. She immediately pushed him away and demanded that they leave. Samantha then drove her car, with David in it, back to their hometown. After she dropped David off at his vehicle, Samantha went home, showered, changed clothes, and then went to the local hospital to be examined. The local hospital conducted a sexual assault kit, which the police collected. Samantha played a voicemail for the police on her phone in which David had left the following message: "I'm so very sorry for what happened. Will you forgive me?" When police asked Samantha for David's telephone number, she provided it without hesitation. When police asked Samantha for Tim's phone number, she told him that she did not know it.

When police contacted David Baxter, he corroborated Samantha's story up to the part where they returned to the hotel room. When they entered the room, David said that Samantha solicited him for sex. While the two of them were engaged in sexual intercourse, David says that Samantha immediately underwent a personality change, pushed him away, and demanded to leave. At no time, David says, did he attempt to touch her again or even ask to continue having sex. David told police that Samantha drove all the way back to their hometown and dropped him off at his car. He adamantly denies sexually assaulting her and says that their sexual intercourse was consensual. David very politely ends the conversation, at that point, before police can ask him about the voicemail, and instructs them to contact his father's attorney.
