The Tigers, a team in the National Football League (NFL), recently enacted a team policy that states that the team "will not allow any person to be a player on the team unless such person is at least 5 feet, 6 inches tall and weighs at least 150 pounds. The purpose of this rule is to reduce the risk of injury to the players due to the physical nature of the sport of football."

Sarah, an outstanding female athlete, who played football in college and who many experts believe could play in the NFL, has filed a lawsuit against the Tigers claiming that the policy above violates Title VII of the Civil Rights Act of 1964. Sarah is 5 feet, 6 inches tall but weighs only 140 pounds. Please discuss one of the following issues:

1. Does the Tigers' policy violate Title VII?

2. What defenses might the Tigers raise as to the legality of this policy?

NOTE: This discussion covers material from chapters 2 and 3 (Employment Law for Business
Author: Bennett-Alexander Edition: 7th.)

It is very important that you follow the IRAC format discussed in the syllabus. Please refer to the laws discussed in the text book and do not simply state your opinion on the issue. This is intended to be based on the existing laws. As you look into this issue, you will see that it is a complex issue and there are many laws that might affect the decision. Take some time to analyze the legal issues.

IRAC Format Below-1Page

Issue(s) - State the issue(s) or question(s) to be decided. May be broad or narrow. (Stated such as "The issue is whether..." or "Does...?") (Hint: pay particular attention to the respective contentions of the parties and/or the questions asked in the problems).

Rule(s) [of Law] - State and explain the applicable rules of law, such as the applicable constitution provision, statute, regulation, or common law principle (write out or summarize - do not just provide the citation). E.g. - Under Texas law, it is illegal to ....

Application - Apply the appropriate rule(s) of law to the specific facts of the case (the court's explanation/reasoning/rationale for its findings/holding/decision in a case brief.....or your reasoning/rationale for your conclusion/outcome/decision in a chapter problem analysis) (should be the longest part of the IRAC analysis).

Conclusion - State the outcome/decision/holding of the case or problem analysis (determination of issues) based on application of law to the facts.
