The family of Edward Mason, now 9, alleged in their lawsuit that after he was born prematurely, two doctors and a neonatal nurse practitioner at the hospital failed to take appropriate measures in response to his symptoms of a potentially fatal condition that afflicts premature infants.

Because of their negligence, parts of Edwards intestines had to be removed, his family argued. He now suffers from a syndrome that makes him unable to digest food and requires continuous tube feeding overnight and additional treatment during the day, according to the family’s lawyers.

A Law suit was filed in Suffolk Courts in Boston against the hospital.

Develop a case study based on then following questions:

1. Imagine that you the Defense Lawyer, write a short synopsis of the case that you will present on behalf of Plaintiff - Edward Mason.

2. State what Laws will be applicable to this case and why. Explain in details.

3. What could be the economic costs incurred by both parties? Use actual dollar amount to support your answer.

4. Develop a complete litigation process including the role of the lawyer and the court

5. Sum -up your case with a make believe decision and penalties.

6. What action will you take if the Hospital wants to settle out of the court. Give an economic analysis of the outcome.
