The Assignment Brief

You are sitting as part of an Appeal court on an appeal against sentence. Choose one of the scenarios in this section to respond to. You cannot respond to the same scenario that you chose for your sentence - i.e you cannot write an appeal for your own sentence. Each sentence has been provided with grounds of appeal.

You should set out your appeal judgement under the following headings:

1. Circumstances of the offending
Brief summary of the charges and surrounding facts

2. Grounds of appeal
Re-state the grounds of appeal

3. Ground 1 / 2 etc
Discussion of the appeal grounds: these will be based on the sentencing principles and purposes studied so far, e.g. too little or too much weight given to a particular consideration or on the basis of adequacy of sentence

4. Discussion of the principles
Brief discussion or recap of the relevant sentencing principles that apply in this case

5. Application of the principles to the facts
Discussion of relevant principles to sentencing facts e.g. aggravating factors such as recidivist behaviour might indicate that offender has poor prospects of rehabilitation or that the community needs to be protected

6. Applicable sentencing range
Indicate an appropriate sentence range for this type of offending

7. Conclusion: do you grant the appeal?
