1. A construction company contracted with the owner of property to construct a garage. The contract stipulated that the construction company would provide all labor, materials, tools, equipment, and other items necessary to construct the garage. The construction progressed and the company put up 20 of the trusses for the roof structure. The next day the trusses fell off the building and could not be used. There was no evidence anyone was at fault for the collapse. The project stalled and the owner said he would pay the company an additional amount of money to replace the trusses and complete the project. When the project was done, the owner refused to pay the extra amount and paid only the original contract price. The construction company sued for the extra amount. What is the likely outcome of this case?

2. A garage owner was repairing the air conditioning on an expensive vehicle and needed a new compressor. The owner researched the part number for the compressor needed and submitted an online order to a parts house for the compressor. When the compressor arrived at the garage it was the wrong model year of the vehicle and would not work. He contacted the supply house and discovered that the part number he ordered was the incorrect part and the parts house had shipped the exact compressor he actually ordered. He sought his money back on the compressor and the parts house refused. If John sues for his money back, what is the likely outcome of his case?
