REQUIREMENTS OF THE PAPER

(1) The Assignment topic is Competition Requirements.

(2) Length of the paper: two (2) to three (3) pages. These pages DO NOT include the Title (Cover Page) Page and the Reference Page.

(3) The paper MUST be typed and double spaced.

(4) STRICTLY follow APA Writing Style format. The APA format includes the Cover Page (including the running head, and header on EVERY PAGE - using the topic title) in text citations, and references. Use Times New Roman font (Size 12) with one (1) inch margins on all sides.

(5) Use a minimum of three (3) references. These must be academic references resulting from your research. DO NOT use Wikipedia.

(7) DO NOT NUMBER paragraphs.

NOTE: For FAR research on this assignment use FAR - Part 15: Negotiated Acquisition.

PAPER STRUCTURE

It is the requirement of this Assignment that your paper be STRUCTURED as provided below. DO NOT start writing your paper until you are certain that you understand what you are required to do.

Introduction
Your paper must begin with a thoughtful introduction relating to selection of contractors, also known as sources, in Competitive Negotiated Acquisition. Your introduction must emphasize that the process of source selection aims at selecting a proposal that offers the most advantageous alternative to the government. The aim is not to select deficient proposals which do not represent the best value to the government. Also, your introduction must stress the fact that in the process of evaluation of factors and sub-factors the government is required by FAR to foster an impartial competitive environment.

Analysis of the Proposal - Adequacy Checklist

In this section of the paper you are asked to analyze the proposal based on the provided Evaluation factors. Here you should determine what to look for in an adequate proposal. You then summarize the intrinsic (that is, the inherent) value of two (2) of the Evaluation factors included on the Checklist. For the assignment you discuss two (2) Evaluation factors from the following Checklist:

(a) Cost and Pricing factor
(b) Past Performance
(c) Technology

End this section of the paper by arguing why you think that the two Evaluation factors you selected are good indicators or measures for the adequacy of the proposal.

Discussion of whether or not the Offeree (the Agency) should let an Offeror's (the Contractor's) mistake within a proposal go uncorrected even if such action would cause the Offeror (the contractor) to withstand a Loss

In this section you decide what position to take. You must support your position.

One Judicial Remedy Available to the Offeror (Contractor) to Prevent the Loss which Resulted from the Offeror's Uncorrected Mistake

The discussion in this section is a follow-up to the position you took in the preceding section. For the purpose of this assignment you assume that the offeree (Agency) did not draw the attention of the offeror to the mistake he or she made in the proposal.

Your argument should be that the uncorrected mistake may lead to two effects:

(a) Uncorrected mistake may result into unexpected increase in costs for project.

(b) Delay in completing the project which may constitute a default, and allow the agency to terminate the contract for default under the Christian doctrine. In both cases, the Offeror should argue that the Agency had a Common law obligation under the Good Faith doctrine to draw the attention of the offeror to the uncorrected mistake. Thus, for increased cost the offeror would have a Judicial remedy of reimbursement. For termination of contract for default, the Judicial remedy of injunction should be available. This would order the Agency not to terminate the contract.
