Presume that in April of 2005, Sally Gant who is African-American was looking for rental housing for herself and her son. Gant saw a phone number in a studio house about an available unit. She termed the number from her workplace. The phone number was for a business possessed by Mark Armstrong. Armstrong is as well the sole owner of the apartment building where Gant sought to rent one of the units. According to Gant a secretary put her review through to Armstrong so that Armstrong could discuss the terms of the rental with her. Gant testified that she inquired Armstrong about the availability of the apartment as well as the number of bedrooms in the apartment.

According to Gant, in the place of answering her substantive questions about the unit, Armstrong asked her a series of offensive as well as discriminatory questions about whether she was American and whether she was Caucasian. Gant was offended as well as told Armstrong that she could not ask those types of questions. Gant didn't tell Armstrong that she was in fact black. His defence is that Gant should have spoken with someone else when she telephoned Armstrong's place of business.
