Under the Privacy Act of 1974, federal agencies cannot keep records any longer than is necessary to fulfill the agency's mission. At the IRS, personal tax returns are purged after three years, unless there is a collection issue in which it goes to ten years. In contrast, at the Social Security Administration, records are kept permanently by necessity - they need to know a claimant's lifelong work history and earnings record to determine benefits. Similarly, Congress, the Courts, and intelligence agencies may also keep permanent records by necessity. However, marketing data brokers have no restrictions whatsoever on the duration they can keep information, what type of information, or who they can provide it to. The average American has more to fear from the private data brokers than from the government. (Waddell, 2015)
