Jill Slick received medical treatment from Walk-On-In Medical Clinic. Upon completion of the treatment she executed an instrument to pay for those services. The instrument read, in relevant part, “Ninety days after date, I, we, or either of us, promises to pay to the order of $3,895.88.” Jill refused to pay on the note. Walk-On-In claimed that this note was bearer paper and as such was payable to the holder. Jill claimed the note was order paper and was therefore payable only to a named payee. Can Walk-On-In, as its bearer, collect on this note?
