Across the country, state legislatures have debated whether their state statutes should be amended to reduce the amount of damages plaintiffs in personal injury cases may recover. For instance, a few years ago, the Idaho Legislature passed a tort reform bill which significantly changed Idaho law. It reduced the cap on noneconomic damages (such as pain and suffering) to $250,000 (down from $682,000). It also put a cap on punitive damages to $250,000, or three times the amount of compensatory damages, whichever is greater. (There had been no previous cap). What do you think about this new law?
