Read through the following scenario.

Kylie and Kevin had been house hunting for some time when they went to a house for sale on Peabody Lane. It had 4 bedrooms, 2 baths and a beautiful yard. Immediately they both agreed that they found their dream house. They had a home inspection and read through all the disclosures on the house. Nothing came out that dissuaded them from their purchase. A month later they moved into their new home.

On the day they moved in, their new neighbor welcomed them to the neighborhood and said how glad he was that someone had bought the house. He explained that he was surprised that it sold so fast considering the fact that the last owner had died in the home.

Kylie and Kevin were shocked and dismayed to find out someone had died in the home.

In your initial post, discuss whether a valid contract existed to purchase the house.

As part of your initial post, make sure to address the following:

Indicate whether there was valid consent in the purchase of the house and provide rationale.

State whether you believe all materials facts were disclosed or not. Was there negligence on the part of the real estate agent? Explain your position.

Note that the facts do not specify how the previous owner died. Does it make a difference if he died of natural causes, suicide, or murder?
