Fixing the following problems -

Assessment 3 -

There is still no completed statement and the submission does not comply with the requirements of the task as listed in the Unit Guide.

No Witness Statement

No Expert Statement

There is no list of evidence included in this submission

There is no list of what evidence is inadmissible

You need to list out each component of the elements of the offence - time / date / place / any person who / ...

You must have an exhibit register detailing what evidence has been collected, who is responsible for this, where it is stored and the last time it was accessed.

Please read through the Unit Guide and then the task assessment before submitting.

Have reviewed your report, Please refer to my comments below to help guide you:

Firstly, you need to use the report template, on the left hand margin page 44, this will help you flow through the requirements of this assessment.

So on page 42 you have your case study for this brief.  You are to use this case to prepare for assessment three also.  In the margin on page 44 you have the 'witness statement information' and 'sample statements' You are required to actually prepare the statements for both Neil Collins and Penelope Andrews.  You will see in the samples that you should have numbered paragraphs and each point is a separate paragraph.  You need to prepare two actual statements here to include in your report.  Your report template has these set up for you already.

For points 3 & 4 you need to use the information from the case study and in the 'evidence guide' on page 45 to help you identify what evidence is admissible and what is non-admissible, so you need to separate these and clearly identify which is which.  For example are the Telstra bills and poker game receipts located at John Adams' residence admissible or non-admissible evidence?

Point 5. You are required to demonstrate your ability to elementise the offence  - refer to page 22 of your unit guide for an example of how to do this.  You know the offence now break it down into its elements and then provide the facilitation of proof and relevant evidence for each element.  The report template has the table set up for you to use.

Point 6 - in the report template there is a register for you to complete, you need to fill this in.

I hope this helps clarify for you.  Follow through the requirements on the report template.

Let me know if you have any further questions.

Assessment 4 -

The attached PDF document outlines what is missing and needs to be addressed in you assessment.  The requirements that are set out in the unit guide are not being answered:

Q1 - Letter of referral - I think you have this confused with a letter for a job referral.  Pg. 28 of the Unit Guide takes you through what is required to be included in the letter for a Brief of Evidence, please read through this.

Q2 - Witness contact details need to be set out as per the example on Pg 29 of the Unit Guide - just three fields of information a required for each witness.

Q3 - Disclosure statement not included - Pg 34 of the Unit Guide covers what is required, and for further information the link on this page will take you to an external site for the Commonwealth Director of Public Prosecutions which provides more detail of what needs to be included.

Q4 - There is no cover sheet attached, this contains information relevant to the brief - Pg 29 of the Unit Guide

Q5 - I'm not sure what any of these links have to do with either the witness or exhibit lists that are required.

Q6 - Where is the list of evidence in relation to the charge?

Please read through the requirements of the assessment with the pages I have referred you to in the unit guide.  At this time there is no information relevant to the assessment included into your submission.
