The Evaluative Need Summary

Profile of the Defendant

The American laws prohibit any person to drink and drive. In equal measures, the law only allows a person whose Blood Alcohol Content (BAC) is at 0.08 to operate any locomotive device. Though most of the drivers across the United States fail to observe this law and go unnoticed, the same was not for Jones Adams, 23 years of age and alumni of Huston University residing in Illinois State.

On 10th of February 2017, Adams was driving to his house after having a long night drinking at a local tavern. According to him, the rough week he had was the reason why he involved himself in such excessive drinking as he wanted to lose a little.

In the course of his driving, he pumped into a police officer who stopped him after noticing him weaving in and out of his lane. After the officer had noted the smell of alcohol which was coming from his breath, the officers persuaded her to stand on his one feet as methods of determining his level of stability.

He failed the test and was subjected to Breathalyzer test which reported that Adam's BAC was .13, above the normal limit of .08. Adams was arrested and taken to police station whereby according to the Administrative Office of the United States Courts (1997), he was charged with driving under the influence of Alcohol hence risking his life and others (Ganong, N. 2015). He has since been sentenced to six months in prison.

Recommended Probation Plan

In America, there is only one type of Aggravated Driving under Influence (DUI) which doesn't attract any severe method of punishment process. That is, driving with a child under the age of 15. Though it is seen as a technical felony, one can only serve one day in jail as punishment, and that is all. On the driving under the influence of alcohol, the case is different.

In the judgment, the judge can either sentence someone to a six-month jail term or on-the-spot fine or both. As the case of Adams, he was condemned to six months in prison with the subsequent probation program. Depending on the punishment module that the court decides, probation must follow. For instance, upon completion of his jail terms, Adams will not be required to drive during his probation period.

He will be expected not to consume any alcoholic substances, he will have to pay off his fines and fees continuously, and above all Adams will be needed by the law to undergo his counseling sessions for the entire probation period. The Probation Office is set aside to be in charge of those under probation plan and suppose one goes astray; the judge will always side with the recommendations from the Probation Office.

Measurement of Probation Plan

During the probation period, the officers in charge will be undertaking some measures to identify the progress level of the probation plan. As for the case of Adams, the Judge, through the Probation Office, will easily monitors the confinement of Adams with the probation requirements. The office would always check if Adams paid his fines promptly. The department would ensure that it knows the whereabouts of Adams so that they can identify if suppose he involves himself in driving during his probation period.

Continuous testing of his blood samples will be done to determine if suppose he is consuming alcohol during his probation period and engaging in driving activities thereby endangering the lives of others. The counselor in charge will be required to submit daily records of his attendance. Any person who know him will be needed to provide any information that might warrant Adams involvement in the same form of offense his period of probation.

Conclusion

Driving while drunk is an adamant offense that can result in death scenarios. Every person who get charged with this form of an offense need to be undertaken in a full cycle of punishment; serving the jail term and undergoing the probation process in totality to prevent further occurrence of the same.

Recommendations

All defendants who complete their sentence terms and process need have their driving privileges restored. Conversely, those offenders who might fail to comply with the conditions of the entire probation programs need not be eligible for any form of license reinstatement. Further, such people (s) need to be returned to the corridors of justice for further judgments which need to have stiffer penalties as compared to the previous ones.
