Does the “punishment” always fit the “crime”? We have seen where services rendered in good faith do not get paid because of a breach of contract. Consider this example: William Thug is a former gang member and was known in the community as a very bad person. He was convicted of violent crimes and has served his time in prison. Part of his parole is to remain lawful and to register every three months as a violent offender. Mr. Thug has been registering timely for the last 4 years. He has served his time and has turned from his violent ways. Due to financial hardship, Mr. Thug could not pay his $20 the last time he registered. He is now charged with non-compliance of his parole, a class A misdemeanor, and could be sent back to prison. Is this fair? Part two: on this thinking, in your mediations, should the punishment be considered or just the violation?
