Part 1 - Contracts

The film "The Social Network" depicts an ill-fated promise. After the Winklevoss twins introduce themselves to Mark Zuckerberg, they pitch him their idea for a social network website called Harvard Connection. In the movie version of these events, Mark accepts their offer: he tells them "I'm in" without hesitation. Is this oral agreement legally enforceable? Explain. (100 words)

Part 2 - Fraud

The Social Network - Deposition Scene

Check out the film clip above, which depicts Mark Zuckerberg's deposition. During this deposition, the lawyer for the Winklevoss twins suggests that Zuckerberg was "leading them on for six weeks" by pretending to work on their Harvard Connection website, when, in reality, Zuckerberg was really working on his own Facebook website all along. So, even if the informal agreement between Zuckerberg and the Winklevoss twins was not a legally-binding contract, did Zuckerberg commit the tort of fraudulent misrepresentation by pretending to work on the Harvard Connection website? Explain. (100 words)

Part 3 - Vampires

Happy Halloween! Professor Guerra-Pujol has taken the position that contracts between humans and vampires for the purchase and sale of blood should be legal. (Check out the Professor's blog post or read his essay "Buy or Bite?") Do you agree? Why or why not? (100 words)
