Dan’s Bike Shop, Inc. manufactures, sells, and repairs bicycles. Pete is a bike enthusiast who rides racing bicycles specially made to travel on bike tracks, pavement, and other smooth surfaces. Pete visited the bike shop and ordered from Dan a custom built racing bicycle for $3,000. Dan installed the pedals, but forgot to sufficiently tighten certain screws that keep the pedals connected to the bicycle. One day Pete took the bike for a ride though Desolate Park, an area of wilderness with steep hills, rocky trails, and other natural wonders. While riding on a bumpy nature trail, one of the pedals popped off the bike. Pete slipped, fell, and broke his leg. Pete incurred medical bills of $10,000 from his injury.

Pete was not at all happy that he hurt himself on the bike ride, and he blamed Dan for his injuries. Pete visited Dan’s shop late at night, where Dan was working alone on some flat tires. Pete stormed into the shop and said to Dan, “I can’t believe the terrible job you did in making me that bike. You are a liar, thief and an outright criminal! You probably run a brothel too! I am never going to shop here again!” Pete left.
