CASE:
Jeb and Jerry are identical twins. It is the night of Jerry and Jackie's wedding at Walsh Bay. Everyone has many glasses of champagne in celebration. During the wedding, Jeb (taking Endone for pain management) makes a speech in which he jokes, ‘Jackie will one day realise she's with the wrong twin. Although we might look the same, Jerry's talents leave a lot to be desired in the bedroom department. Me, on the other hand...' In response to this, Jerry, demonstrably furious, mimicked the action of pulling the trigger of a gun, pointed at Jeb, then whispers something in his ear. After the wedding, while Jerry is still saying goodbye guests, Jeb sneaks into Jackie's hotel room. He proceeds to have sex with Jackie. After about 5 minutes, Jackie, in a drowsy state, asks, ‘Jeb, is that you?'
OPENING ADDRESS is required? (criminal justice)
but it should include answers for the following questions only:
1. Give a clear and concise overview of how the evidence you will present will prove your case
2. Identify any ambiguities or disputes in the facts, and how these should be resolved
3. Anticipate/Rebut the other side's arguments and address them accordingly
4. Conclude on what the final outcome should be.
What is an Opening Address?
In an Opening Address, barristers representing both sides introduce their case to the judge and jury as clearly and persuasively as possible. It is given in the future tense, as in "testimony will show" or "evidence will show." The address is not intended to be argumentative, but rather, to lay out a general picture of how the facts support your case. Consider why should your client be found not guilty, or why should the defendant be found guilty? What evidence do you intend to present and what witnesses to you intend to call to support your case? How will you prepare to counter the opposing side's opening arguments during the next phase?
Objective: To acquaint the judge and jury with the case, outline what you are going to prove (or defend), and how you are going to prove it (or defend it).
