The Dog Bite Case: "Roseman v. Tyler's Sports Bar"

1. Read the hypothetical question - Separately Posted on Blackboard

2. Answer the following questions based on Clark v. Clark - Separately Posted on Blackboard

3. Questions:

a. What is the legal issue?

b. Is the Bar legally liable for the injuries sustained by Mr. Roseman as a result of Banner (the dog) jumping into the stands? Why or why not?

c. Is it a defense that Banner was not vicious and never bit anyone before this incident?

d. Is it a defense that this was the first time that Banner went into the stands to retrieve a football? Are there any defenses that will help the bar?

Separately answer the questions by using these guidelines:

1. Use all sources; cite the website - no need to cite the text.

2. Do not summarize the facts of the hypothetical in an introductory paragraph.

3. ALWAYS compare the facts of the hypothetical to the facts of the precedent case that has been assigned when answering the questions.

4. Find the rule of law in the precedent case

5. APPLY the rule of law in the precedent case to the hypothetical

6. Decide who wins and who loses based on #3 & #4
