Title I of the Americans with Disabilities Act (ADA) of 1990 prohibits private employers, state and local governments, employment agencies and labor unions from discriminating against qualified individuals with disabilities in job application procedures, hiring, firing, advancement, compensation, job training, and other terms, conditions, and privileges of employment.

In response to the discussion board question, there would be significant consequences to the employer who deals in this type of employment practice. The applicant may have filed worker's compensation due to an injury sustained while working in an environment that was not ADA compliant. Under the ADA, employers are required to make modifications or reasonable accommodations for employees with disabilities who are otherwise qualified and, ensure that they are working in a safe environment.

However, there are some employers who, in spite of the ADA are still non- compliant with the rules. They feel like it would be too much of a bother and/or too expensive to accommodate the disabled. They might have to add lifts, or ensure the employee's office can accommodate a wheelchair if needed.

This practice of rejecting applicants who have filed worker's compensation claims is discriminatory against people with disabilities. In fact, this practice is discriminatory in general whether the applicant is disabled or able. People file claims for different reasons and should not be penalized for doing so. For example, the applicant may have filed a claim because something fell from a shelf and hurt him. This type of accident was due to no fault of the individual. Another example would be slipping on liquid spilled on the floor. A situation that people at my agency deal with on a daily basis is walking into other people. The building is set up in a way where there are a lot of corners to turn. Almost everyday, I swing around one of those corners only to end up face to face with someone coming from the opposite direction. If we were both distracted and walking a fast pace, we would run right into each other and possibly knock each other down. This would definitely cause an injury to one or both of us.

An estimated 54 million Americans are living with a disability, and those numbers could rise significantly as dramatic medical "advances reduce military casualties among soldiers now fighting in Iraq and Afghanistan (Nation's Health, 2008).
