A prospective new tenant, Café WiiWii, a cyber café concept approached the landlord about leasing space in the landlord’s power strip center. The Café WiiWii concept is adaptable to almost any development (mall, shopping center, mixed use, office building). The landlord has a radius restriction clause in the lease that prohibits a tenant from opening any other Café WiiWii or owning a similar concept in any type of development within 10 mile radius of the premises. The landlord really likes this concept and feels it would be a very popular and successful draw in its power center. Café WiiWii cannot live with this radius restriction. The landlord will not budge on this clause for this tenant, though the landlord has modified the clause for national tenants.
