A Hispanic male aged 47 applies for a job. He speaks with the company recruiter, who tells him the expected start date, duties, regular hours, and pay range for the position. He interviews with the hiring manager, a white male aged 50. A week or so later, the recruiter contacts the gentleman to inform him that the hiring manager selected an internal candidate to fill the role. The internal candidate is a Hispanic female aged 42. The Hispanic male raises claims of race, gender, and age discrimination. If you were the HR manager investigating the claims, what information would you want to know?

Who would you want to interview? Are there any documents you think are relevant to your investigation? Analyze the legal viability of the claims based on the information provided. Examine how your analysis may change if different factors are introduced, such as discovery of falsification of the Hispanic male's resume or evidence that the Hispanic female never interviewed for the position (or any other factor you think may change the scenario). Provide your thought process and discuss the relevant laws. In addition, discuss how you think a proper investigation and/or response to the applicant should be delivered. Don't try to answer each of these questions in one post. Focus on one area and discuss it fully in one post and then turn to another area for a different post. Or, if prior responses have focused mainly on one area of these questions, turn your attention to a different area of inquiry. Remember, the goal of discussion boards is to stimulate conversation, while substantively discussing concepts from the text with the outcome of increasing your ability to approach scenarios as an HR professional.
