A client is getting a new side fence and discovers that the old fence which is 17 years old is not in the correct place according to the title. Their fence line is misaligned with the title boundary (6 inches x 150 feet in total area) in their favour. The neighbours want it replaced and back to where it should be according to the title.

Your client has built a garage on the boundary and is requiring advise. They are concerned that the matter is getting ugly and it is affecting their relationship with their neighbour which is long standing.

You need to explain the relevant law and where they stand. Explain the difference between ownership and possession. (That is land defined by title versus land possessed.)
