1. Discuss the elements of a cause of action based on negligence? Make sure that if a part of the elements has multiple components (like causation) that you discuss those too.

2. Thoroughly identify and explain the elements of a cause of action (lawsuit) based on the intentional infliction of emotional distress?  In other words, what does the plaintiff have to show or prove to win his case?

3. Identify and define the defenses that could exist in a cause of action for negligence?

4. What are factors that can determine whether an individual is considered an employee or an independent contractor?  Explain how the factors work.  Why does it matter?

5. Discuss in detail how an agency relationship can be created?  Identify and describe the categories of authority by which an agent can bind a principal and a third party in contract.
