Write my legals case brief. Attached is the case which the brief needs to be written on as well as a sample brief. The brief needs to be two pages single spaced, despite the sample being three pages (ok if it goes over slightly), and it is extremely important to keep the format. You will see based on the sample brief that parts 6-8 are the most imporatnt. The professor is particular on the language of the brief and lowers points if the whole thing is in lamence terms (not saying this needs to be a written by a legal schoalr either).

CASE ANALYSIS FORMAT

You must use this format to brief cases in my classes.

1. CITATION & DATE: Name of the Case and official case citation (read Chapter 1 to find what the citation is.) Date of this decision (only list the "date decided" - ignore the "date argued" date.)

2. COURT: Name of the Court that is issuing THIS decision.

3. PARTIES: Identify the parties involved in this case and note their titles (Plaintiff; Defendant; Petitioner; Respondent)

4. FACTS: Briefly summarize what happened to the plaintiff(s) that forced him/her/it/them  to bring a lawsuit against the defendant(s).

5. LEGAL ISSUE(S): What are the underlying laws and/or legal principles(s) that this Court has to review? Remember to specifically cite their names here, and reference them again in section 8 (Rationale) below.

6. POSITIONS: Briefly describe each of the legal claims, of each party, in this appeal. In other words, what are their respective positions as to how the Court should decide the legal issues? This section should mirror the previous "legal issues" section - if there are 2 (or 3) legal issues listed, then each party will have 2 (or 3) positions in your brief.

7. HOLDING: What is the majority opinion of the Court in this decision? You must include a Holding for each legal issue that you listed in section 5. You can ignore the dissenting opinions, as Dissents are not law, merely the opinions of the judges in the minority.

8. RATIONALE: This section is the most important part of the brief. It summarizes the majority's "reasons" (rationale) for deciding the case the way it did. This section, also, should mirror the legal issues you listed in section 5 - there must be a Rationale for each legal issue/question/specific law involved.
