Joe Creepy is a 27-year-old carpenter who developed a friendship with a girl named Candy whom he met in an online chat room. After messaging back and forth for several weeks, they agreed to meet and have sex. Candy told Joe that she was 18 years old and gave him her address to come pick her up. That night, he drove 100 miles to her home and she met him outside. They drove to a nearby park and had sexual intercourse in his pickup truck.

After they were done, Joe drove Candy back to her home. Candy's parents caught her coming back in and confronted her. She told them she had just had sex. They brought her to the police station because she was only 15 years old. They demanded that Joe be arrested.

When you speak with Candy, she admits that she told Joe she was 18 and even showed him her sister's birth certificate to prove it. Candy said she wanted to have sex with Joe and loves him.

When you contact Joe, he is shocked that Candy is only 15. He also says she said she was 18 and showed him a birth certificate to prove it. He also said that she looked like she was 18.

Has Joe committed a crime based on Minnesota Statutes? Write a 1-page paper indicating what crime (if any) you feel that Joe has committed. In your paper, include the elements of the statute that apply in this case. If you feel that Joe has not committed a crime, indicate why you feel that no crime was committed and what would have to change in the circumstances for him to have committed a crime.
