The SUPERFUND law places liability on any current or past owner of a SUPERFUND site, as well as anyone who ever transported hazardous waste to that site. Now think about this: a trucking company hauls just ONE load of hazardous materials to a dump. Twenty (20) years later, the site is declared a SUPERFUND site. The original owners have long vanished & the current owner is nearly bankrupt. The EPA looks at the records & finds the trucking company that just hauled one (1) load twenty (20) years earlier. The EPA goes after that trucking company for the full cost of the SUPERFUND cleanup. Is that fair? Why/Why NOT?
