Case study - Faulty mobile phone

Abel bought her daughter Carol a new mobile phone for New Year which turned out to be faulty. Both were very disappointed as Carol really needed a new phone.

Abel went back to the store and asked for a refund, but the store refused. They said they could only replace it once they checked its fault. However, Abel kept insisting on the refund as she bought something that did not work. The shop continued to say it was not their policy to refund money. The shop further argued that there was a sign in his store stated that, ‘We will exchange, repair or give credit notes but we do not refund'.

Discuss the followings issues:

1. What do you think the legal right of Abel under the Sale of Goods Act 1957 and the Consumer Protections Act 1999. Decide the extent the consumer protection law protects Abel and other consumer in the above situation.

You are expected to identify the legal right of Abel i.e. her right to get her money back based on the relevant legal provisions from the Sale of Goods Act 1957 and the Consumer Protections Act 1999. All the related points of law to support your arguments must be discussed. You need to take into consideration the sign and the possible signs placed in the store in arguing your answer. The article on the unfair term will be relevant to help you in exploring the legal position of those signs.

3.1 Objectives

This group assignment is for the students to explore the possible legal and ethical issues in business practice that closely relate to consumers. The students are expected to discuss all the issues in the perspectives of legal and ethics.
