Question: Review local ordinances on smoking (90 minutes)

In this homework we will be looking local ordinances related to health. As a side note it is important to remember that the Idaho Legislature has a requirement that no Idaho law can be more stringent than a Federal law. However, a city or county ordinance in Idaho can be more stringent than an Idaho law. We will look at with Second Hand Smoke. I have purposely left off the hot links to the Codes and Boise City Ordinances so you can practice finding specific statutes and rules in preparation for the final examination.

Step 01: Start by going Idaho Clean Indoor Air Act, Title 39, Chapter 55 specifically 39-5503. PROHIBITIONS - EXCEPTIONS. Keep this open and now access the Boise City Ordinance 6-23 Boise City Smoke Free Air Ordinance.
Please answer the following questions:

a. When you review the exception under the Idaho Code what is your impression of the areas allowed to continue smoking activities?

b. Which areas that were exempted by Idaho Code cannot allow smoking under the Boise City Ordinance?

c. When you compare IC 39-5502. DEFINITIONS WITH the Boise City definitions are there additions to the City Ordinance beyond what is defined in Idaho Code? If so what are they?

d. What are the enforcement provisions under Boise City 6-23-13?

e. How do the Boise City enforcement provisions compare to the Idaho Code 39-5507? Which in your opinion is stricter?

Step 02: In this section you will do a Google search for another city smoking ordinance. Note the city does not have to be in Idaho

1. Which City did you find with a smoking ordinance?

b. Comparing the two ordinance answer the following questions:

a. How does the ordinance compare to Boise's Ordinance?

b. Which ordinance is stricter in your opinion?

c. Why do you feel it is stricter?

d. How do the enforcement provisions compare?
