Maria gave her boyfriend, Mark, a check, but she left the amount incomplete. The check was given as partial payment for a $2,000 loan that Mark made to Maria three months ago.  The amount was left blank because Maria was in a hurry. Maria signed a blank check and told Mark to fill out the check for $500. Mark needed to make an $800 car payment, so he wrote the check for $800 and cashed it at Maria's bank. Maria was upset when she found out about it. She broke up with Mark and demanded that he immediately pay her the $300 difference. Mark refused claiming Maria owed her more than that. Maria threatens to sue Mark for the $300.

Thomas, an employee of Lawler's Plumbing, cashed his last paycheck at SpeedyCash, Inc. Lawler's  issued a stop payment order on the check. The manager at Lawler's Plumbing determined that Thomas had not earned a check for his last week of work. Other employees claimed that they had punched the clock for Thomas that week. The bank returned the check to SpeedyCash, Inc. The markings on the check indicated that the bank would not issue funds for the check. SpeedyCash, Inc. argued that it was entitled to payment. SpeedyCash brought an action for payment against the bank.

Will SpeedyCash, Inc. be successful?  Why or why not?
