  1. The terms of a contract are of two types. State them and give an example of each.
  2. Sir Galahad advertises the sale of a portrait of his ancestor which he believes was painted by the famous European painter, Michael Angelo. Mr. Know It All inspects the painting and is also advised by an experienced art critic. Both are satisfied that it was painted by Michael Angelo. Mr. Know It All pays $250,000.00 for the picture but recently it has been discovered that it was painted by an obscure amateur artist. Mr. Know It All wishes to return the picture to Sir Galahad and obtain a refund of his money. Sir Galahad has refused to refund the money. Will Mr. Know It All succeed if he sues Sir Galahad? Give legal reasons for the answer.
  3. Y Cleaners Limited offered "to clean two garments for the price of one". A notice was displayed in the shop to this effect but with the addition, in smaller print, of a statement that the customer must agree to accept full responsibility if anything should happen to the garments. A similar statement was printed on the back of the tickets which were handed to customers when they deposited the garments.

Mr. Elderly brought two jackets for cleaning. Because of poor eyesight he was unable to read the small print on the notice, and he put the ticket in his pocket without reading it. Some days later when Mr. Elderly collected the jackets he saw that one had been badly torn. After wearing the other jacket he contracted a skin disease which was caused by a chemical which the cleaners used. Advise Mr. Elderly.
