Domicile law of UK

However a person's domicile is such country in where he either has or is deemed through law to have, his permanent home.  Hence it is the country of permanent residence.

Moreover the UK law relating to domicile is contained in the Law of Domicile Act, Cap 3. So hence the Act codifies the common law rules relating to domicile regarding some amendments.  Well Under the provisions of this Act these are the types of domicile, namely as;

Domicile of Origin

However domicile of origin is acquired through a person at the moment of his birth. Thus Section 3 of the Law of Domicile Act provides such every person shall be deemed to have acquired, on date of his birth:

  1. Whether he is born legitimate or deemed to be legitimate, then the domicile of his father, or whether he is born posthumously, then the domicile that his father had at the date of his death.
  2. Whether he is born illegitimate, the domicile of his mother.

However these provisions codify the common law rules regarding acquisition of domicile of origin. Thus the Act also makes the following provisions as;

                   (i) Whereas an infant who is legitimated through the marriage of his parents shall acquire the father's domicile at the date of legitimating.

                   (ii) Whereas Section 4 states that an infant that who is a foundling shall be deemed to have acquired the domicile of the country when he is found.

                   (iii)  Whereas Section 5 provides that an infant that whose adoption has been authorized through a court shall acquire the domicile of the adopter or, whether adopted through two spouses, that of the husband.
