Introduction

The purpose and aims of this course are for you to achieve the following learning outcomes:

1. Understand the legal requirements for a valid contract

2. Understand the meaning and effect of terms in a standard form contract

3. Understand the impact of statutory consumer protection on the parties to a contract

4. Know the remedies available to the parties to a contract.

Scenario - Prepare a Law Briefing report

You are working as a legal intern for a small business advisory service. You have been asked to prepare a legal report for consumers next month. The report should have 4 sections as detailed below (which also contains some suggested indicative content as how to demonstrate that you have met all the assessment criteria contained in the assessment grid). Demonstrate your academic knowledge by giving definitions of key terms, by mentioning real-world examples and by refereeing to examples from case law from your textbooks and class hand-outs.

Section 1 -The legal requirements for a valid contract

1. identify the legal criteria for offer and acceptance in a valid contract

2. explain the law in relation to the formation of a contract in a given situation

3. describe the law with respect to misrepresentation in a given situation

4. analyse the impact of the requirements for a valid contract in a given situation

Section 2 - The meaning, and effect, of terms in a standard form contract

1. describe the meaning of terms in a standard form contract

2. explain the effect of terms in a contract

Section 3 - The impact of statutory consumer protection on the parties to a contract

1. explain the law with respect to consumer protection in given situations

2. analyse how consumers are protected in the event of breach of contract for the supply/sale of goods or services

Section 4 - The remedies available to the parties to a contract

1. describe the remedies available for breach of contract.

2. analyse the remedies available to a business provider in the event of breach of contract for the supply of goods or services.
